ความหมายของ Legal Personality

Legal Personality คือ สถานะทางกฎหมายที่บุคคลหรือนิติบุคคลมีสิทธิและหน้าที่ตามกฎหมาย บุคคลที่มี Legal Personality คือ บุคคลที่มีสิทธิและหน้าที่ตามกฎหมายโดยธรรมชาติ เช่น มนุษย์ สัตว์เลี้ยง ส่วนนิติบุคคลที่มี Legal Personality คือ นิติบุคคลที่กฎหมายสร้างขึ้น เช่น ห้างหุ้นส่วนจำกัด บริษัทจำกัด

ประเภทของ Legal Personality

Legal Personality สามารถแบ่งออกเป็น 2 ประเภทหลักๆ ดังนี้

• Legal Personality ของบุคคล หมายถึง สถานะทางกฎหมายที่บุคคลมีสิทธิและหน้าที่ตามกฎหมาย โดยบุคคลที่มี Legal Personality จะต้องมีคุณสมบัติตามที่กฎหมายกำหนด เช่น มนุษย์ต้องมีอายุครบ 18 ปีบริบูรณ์ สัตว์เลี้ยงต้องได้รับการจดทะเบียนตามกฎหมาย
• Legal Personality ของนิติบุคคล หมายถึง สถานะทางกฎหมายที่นิติบุคคลมีสิทธิและหน้าที่ตามกฎหมาย โดยนิติบุคคลที่มี Legal Personality จะต้องได้รับการจดทะเบียนตามกฎหมาย เช่น ห้างหุ้นส่วนจำกัด บริษัทจำกัด

สิทธิและหน้าที่ของ Legal Personality

บุคคลหรือนิติบุคคลที่มี Legal Personality จะมีสิทธิและหน้าที่ตามกฎหมาย ซึ่งสิทธิและหน้าที่เหล่านี้จะถูกกำหนดโดยกฎหมาย โดยสิทธิของบุคคลหรือนิติบุคคล ได้แก่ สิทธิในการครอบครองทรัพย์สิน สิทธิในการเป็นเจ้าของ สิทธิในการดำเนินการต่างๆ เป็นต้น ส่วนหน้าที่ของบุคคลหรือนิติบุคคล ได้แก่ หน้าที่ปฏิบัติตามกฎหมาย หน้าที่ชำระภาษี หน้าที่ดูแลรักษาทรัพย์สิน เป็นต้น

ตัวอย่างของ Legal Personality

ตัวอย่างของบุคคลที่มี Legal Personality ได้แก่ มนุษย์ สัตว์เลี้ยง ตัวอย่างของนิติบุคคลที่มี Legal Personality ได้แก่ ห้างหุ้นส่วนจำกัด บริษัทจำกัด มูลนิธิ สมาคม เป็นต้น

ความสำคัญของ Legal Personality

Legal Personality มีความสำคัญต่อบุคคลและนิติบุคคล เนื่องจาก Legal Personality จะช่วยให้บุคคลและนิติบุคคลสามารถมีสิทธิและหน้าที่ตามกฎหมาย ซึ่งสิทธิและหน้าที่เหล่านี้จะเป็นประโยชน์ต่อบุคคลและนิติบุคคลในด้านต่างๆ เช่น ด้านทรัพย์สิน ด้านหนี้สิน ด้านการดำเนินกิจการ เป็นต้น
